1. Acceptance of Terms

By creating an account, downloading, installing, or using FlowPalette, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and FlowPalette ("we," "us," or "our").

2. Description of Service

FlowPalette is a mobile application designed to help neurodivergent individuals, particularly those with ADHD, manage tasks, track mood and energy levels, and maintain focus through gentle, adaptive features.

Core Features

• Task Management: Create, organize, and complete tasks based on your energy levels
• Mood & Energy Tracking: Track your daily mood and energy to better plan your day
• Focus Companion: Pomodoro timer and focus session tracking
• Voice-to-Text: Create tasks using voice input (processed locally on your device)
• Haptic Feedback: Gentle, ADHD-friendly haptic patterns

Premium Features

• Unlimited task creation
• Cloud sync across devices
• Advanced analytics and insights
• Gentle reminders and notifications
• Advanced Focus Companion features
• Full mood and energy history
• Task templates and customization

3. Eligibility

To use FlowPalette, you must:

• Be at least 13 years of age
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Service under applicable laws

4. User Accounts

Account Creation

To access certain features of FlowPalette, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Keep your password secure and confidential
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

Account Security

You are responsible for maintaining the confidentiality of your account credentials. We recommend:

• Using a strong, unique password
• Not sharing your account with others
• Enabling two-factor authentication if available
• Logging out after each session on shared devices

Account Termination

You may delete your account at any time through the App settings. Upon deletion:

• Your account and all associated data will be permanently deleted within 30 days
• Active subscriptions will be cancelled (see Subscription section)
• This action cannot be undone

5. Subscription and Payment

Free Version

FlowPalette offers a free version with limited features, including:

• Limited number of tasks
• Basic mood and energy tracking
• Basic focus companion
• Local data storage only

Premium Subscription

FlowPalette Premium is available as a subscription service with the following terms:

Free Trial

We may offer free trials for Premium subscriptions. By starting a free trial:

• You authorize us to charge your payment method when the trial ends
• You can cancel anytime during the trial without being charged
• Free trial eligibility may be limited to new users
• We reserve the right to modify or cancel free trial offers

Refunds

Refunds are handled by Apple App Store or Google Play Store according to their policies:

• Apple: Request refunds through Apple App Store
• Google: Request refunds through Google Play Store
• We do not process refunds directly

Price Changes

We reserve the right to change subscription prices at any time. Price changes will:

• Be communicated to you in advance
• Take effect at the start of your next billing cycle
• Give you the opportunity to cancel before the new price takes effect

6. User Content and Data

Your Data

You retain all rights to the content and data you create in FlowPalette, including:

• Tasks and task descriptions
• Mood and energy tracking data
• Focus session history
• Personal notes and templates

License to Use Your Data

By using FlowPalette, you grant us a limited license to:

• Store your data to provide the Service
• Process your data to deliver features and functionality
• Use anonymous, aggregated data for analytics and improvements

Data Backup

You are responsible for maintaining backups of your data. We recommend:

• Using the Premium cloud sync feature for automatic backups
• Periodically exporting your data (Premium feature)
• Not relying solely on local device storage

7. Acceptable Use Policy

You agree to use FlowPalette only for lawful purposes and in accordance with these Terms. You agree NOT to:

Prohibited Activities

• Use the Service for any illegal purpose or in violation of any laws
• Attempt to gain unauthorized access to the Service or other users' accounts
• Reverse engineer, decompile, or disassemble the App
• Remove or modify any copyright, trademark, or proprietary notices
• Use automated scripts, bots, or crawlers to access the Service
• Interfere with or disrupt the Service or servers
• Upload malware, viruses, or malicious code
• Harass, abuse, or harm other users
• Impersonate any person or entity
• Collect or harvest user information without consent

8. Intellectual Property

Our Rights

FlowPalette and all related content, features, and functionality are owned by us and are protected by copyright, trademark, and other intellectual property laws.

This includes but is not limited to:

• App design, interface, and user experience
• FlowPalette name, logo, and branding
• Source code and software
• Documentation and content
• Proprietary algorithms and features

Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on your personal devices
• Use the App for personal, non-commercial purposes
• Access features according to your subscription level

This license does NOT grant you the right to:

• Modify, copy, or distribute the App
• Create derivative works
• Sell, rent, or lease the App
• Use the App for commercial purposes without permission

Feedback

If you provide feedback, suggestions, or ideas about FlowPalette, you grant us the right to use them without compensation or attribution.

9. Disclaimers and Warranties

Service Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

We disclaim all warranties, including but not limited to:

• Warranties of merchantability and fitness for a particular purpose
• Warranties that the Service will be uninterrupted or error-free
• Warranties regarding the accuracy or reliability of data
• Warranties that defects will be corrected

Third-Party Services

The Service may integrate with third-party services (Firebase, RevenueCat, etc.). We are not responsible for:

• Third-party service availability or functionality
• Third-party privacy practices or data handling
• Third-party terms of service or policies

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLOWPALETTE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or use
• Business interruption
• Personal injury or property damage
• Emotional distress
• Loss of goodwill or reputation

Our total liability to you for any claims arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 USD, whichever is greater.

11. Indemnification

You agree to indemnify, defend, and hold harmless FlowPalette and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your violation of any applicable laws or regulations
• Your content or data

12. Termination

Termination by You

You may terminate your account at any time by:

• Deleting your account through the App settings

Termination by Us

We may suspend or terminate your account immediately, without notice, if:

• You violate these Terms
• You engage in fraudulent or illegal activity
• Your account has been inactive for an extended period
• We are required to do so by law
• We discontinue the Service (with reasonable notice)

Effects of Termination

Upon termination of your account:

• Your access to the Service will be immediately revoked
• Your data will be deleted within 30 days
• Active subscriptions will be cancelled
• Sections of these Terms that should survive termination will remain in effect

13. Modifications to Service and Terms

Changes to the Service

We reserve the right to:

• Modify, suspend, or discontinue any feature of the Service
• Change subscription pricing with advance notice
• Update the App to fix bugs or add features
• Discontinue the Service entirely (with reasonable notice)

Changes to These Terms

We may update these Terms from time to time. When we do:

• We will update the "Last Updated" date
• We will notify you through the App or via email
• Material changes will be communicated prominently
• Your continued use constitutes acceptance of the new Terms

If you do not agree to the updated Terms, you must stop using the Service and delete your account.

14. Governing Law and Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions.

Dispute Resolution

In the event of any dispute arising from these Terms or your use of the Service:

You agree to bring claims against us only in your individual capacity and not as a plaintiff or class member in any class or representative action.

Time Limitation

Any claim or cause of action arising from these Terms or the Service must be filed within one (1) year after the claim arose, or it will be permanently barred.

15. Miscellaneous

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FlowPalette regarding the Service.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Assignment

You may not assign or transfer these Terms or your rights under them without our written consent. We may assign our rights and obligations without restriction.

Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, internet failures, or government actions.

Export Control

You agree to comply with all applicable export and import laws and regulations when using the Service.
